James J. Brown, III (WSBA No. 14945, admitted May 1985) was ordered suspended from the practice of law for one year and placed on probation for five years effective September 9, 1998 by order of the Washington State Supreme Court. The discipline imposed was reciprocal to Brown’s suspension in the State of California. By order of the State Bar Court of the State Bar of California filed on April 15, 1998, Brown was suspended from the practice of law for five years, execution stayed, and placed on probation for five years on conditions that he be actually suspended from the practice of law for one year and until he makes certain restitution. Brown stipulated to the disposition and to findings that he was convicted of one count of felony spousal battery, that he was convicted of four felony counts for the unauthorized practice of law, that he shared legal fees with a person not licensed to practice law, that he failed to competently perform legal services for several clients, and that he failed to provide clients with accountings of attorneys fees and of settlement proceeds. Brown did not respond to the Washington State Supreme Court’s order issued pursuant to Rule 12.6 of the Rules for Lawyer Discipline, which directed him to inform the court of any claim that the imposition of identical discipline in this state would be unwarranted and, if so, the reasons therefore.
